La Cour de justice: techniques et instruments [La Corte di giustizia: tecniche e strumenti]

The project consists in the offering of a teaching class in EU procedural law. The class will be practical and aimed at providing students not only with theoretical information, but also the real possibility to acquire the necessary skills to write a brief and prepare a pleading within the judicial procedure before the EU jurisdictions. Moreover, owning to the professional experience of the teacher, legal clerk (référendaire) at the Court of justice, the class will also cover the working techniques, including the inner procedures, at the Court of justice. The teaching techniques are innovative for Italian standards. No frontal teaching will be provided. A syllabus of materials will be prepared and distributed to students, who will be asked to study all relevant material before each class. The evaluation of the students' performance will take account of both the result of a final exam aiming at verifying the theoretical knowledge acquired as well as participation in class.The project also includes a working session. Students will be asked to follow "live" a case pending before the Court of justice. In accordance with the Court's calendar, the case will be chosen at the beginning of the class (with a preference for a preliminary reference procedure) and all stages of the procedure, from the lodging of the application to the reading of the judgment, will be analyzed in depth. Students will also be given the opportunity to visit the Court in Luxembourg in order to assist at the hearing in that very same case. On this occasion, they will meet other legal clerks and members of the Court.Finally, the project includes 2 annual seminars in which different topics in relation with the subject-matter of the project will be thoroughly examined. These seminars will be organized in cooperation with the Milan bar and/or court.
